Aurora USA Soccer Academy ("AUSA,""we," "our," or "us") is a nonprofit youth soccer organization based in Aurora / Oswego, Illinois. By accessing our website at aurorausasoccer.com, using our parent portal at view.aurorausasoccer.com, or enrolling in any AUSA program, you ("parent," "guardian," or "participant") agree to be bound by these Terms and Conditions.
1. Acceptance of Terms
By using our website, parent portal, or any AUSA services, you confirm that you are at least 18 years of age, have the legal authority to enroll a minor in our programs, and agree to these Terms and Conditions in full. If you do not agree, please discontinue use of our services immediately.
2. Program Enrollment
Enrollment in AUSA programs (seasonal teams, tryouts, summer camps, and clinics) is subject to availability and is not guaranteed until payment is received and confirmed. AUSA reserves the right to decline or cancel an enrollment at its discretion. All enrollment information must be accurate and complete; providing false information may result in immediate removal from the program without refund.
3. Payments and Fees
All program fees are due at the time of registration unless a payment plan has been explicitly approved by AUSA administration. Payments are processed securely through Stripe. AUSA does not store credit or debit card information on its servers. Returned payments or failed transactions may result in a service fee and suspension of participation until the balance is resolved.
4. Refund Policy
Refunds are subject to AUSA's separate Refund Policy, available on our website. By enrolling in any program, you acknowledge and agree to the terms of that policy. AUSA reserves the right to modify its refund terms at any time with reasonable notice.
5. SMS Communications
By providing your mobile phone number and checking the consent checkbox during registration in our parent portal at view.aurorausasoccer.com, you expressly consent to receive SMS text message notifications from Aurora USA Soccer Academy. These messages may include:
- Game schedules and location updates
- Practice cancellations or changes
- Payment reminders and confirmations
- General academy announcements
Message frequency varies based on program activity. Message and data rates may apply depending on your mobile carrier. To opt out at any time, reply STOP to any message. To request assistance, reply HELP. Consent to receive SMS messages is not required as a condition of enrollment or participation in any AUSA program. We do not share your mobile phone number with third parties for marketing purposes.
6. Code of Conduct
All players, parents, and guardians are expected to conduct themselves in a respectful and sportsmanlike manner at all times during AUSA events, practices, games, and communications. AUSA reserves the right to suspend or remove any player, parent, or guardian from the program without refund for behavior that includes but is not limited to:
- Verbal or physical abuse toward players, coaches, referees, or staff
- Harassment or bullying of any kind
- Violation of league or facility rules
- Repeated failure to comply with AUSA policies
7. Photo and Media Release
By enrolling in an AUSA program, you grant Aurora USA Soccer Academy a non-exclusive, royalty-free license to use photographs, videos, and other media featuring your child taken during AUSA events for promotional and organizational purposes, including on our website and social media channels. If you wish to opt out of this release, you must notify us in writing at contact@aurorausasoccer.com prior to your child's first event.
8. Health and Medical Authorization
You represent that your child is physically able to participate in soccer activities. In the event of a medical emergency during an AUSA event, you authorize AUSA staff to seek emergency medical treatment on behalf of your child if you cannot be reached. AUSA is not responsible for medical costs incurred as a result of participation in our programs. You are encouraged to maintain appropriate health and accident insurance coverage for your child.
9. Assumption of Risk and Waiver of Liability
Participation in soccer and athletic activities involves inherent risks of injury. By enrolling your child in an AUSA program, you voluntarily assume all risks associated with participation, including but not limited to physical injury, illness, or property damage. To the fullest extent permitted by Illinois law, you waive any claims against Aurora USA Soccer Academy, its officers, directors, coaches, volunteers, and staff for injuries or damages arising from participation in our programs, except in cases of gross negligence or willful misconduct.
10. Intellectual Property
All content on aurorausasoccer.com and view.aurorausasoccer.com, including logos, text, images, and software, is the property of Aurora USA Soccer Academy or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any AUSA content without our prior written consent.
11. Third-Party Services
Our website and parent portal integrate with third-party service providers including Stripe (payment processing) and Twilio (SMS delivery). Your use of these services is also subject to their respective terms and privacy policies. AUSA is not responsible for the practices or content of third-party providers.
12. Limitation of Liability
To the maximum extent permitted by applicable law, AUSA's total liability to you for any claim arising out of or related to these Terms shall not exceed the total amount of fees you paid to AUSA in the twelve (12) months preceding the claim. In no event shall AUSA be liable for indirect, incidental, special, consequential, or punitive damages.
13. Modifications to Terms
AUSA reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website with a revised effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms. For material changes, we will make reasonable efforts to notify enrolled families by email.
14. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the State of Illinois, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall first be attempted to be resolved informally by contacting AUSA at contact@aurorausasoccer.com. If not resolved within 30 days, disputes shall be submitted to binding arbitration in Kane County, Illinois, under the rules of the American Arbitration Association.
